If you do not already know this, the appellate court in Texas ruled that a persons gender is determined by their chromosomes regardless of any sex change surgery. This upheld a lower court decision and the Texas Supreme Court refused to hear the case. As a result the plaintiff who was sueing for the wrongful death of her husband of 7 years was declared not really the wife of the deceased, allowing the defendant and the insurance company to go scott free without paying a thing. By the way it was the Insurance company that came up with this legal technique to avoid paying out a claim which they were clearly entitled to pay.

You might think this does not effect you, however that would be a mistake. Were this ruling to become widespread it could effect the lives of the entire Transgendered Community not to mention couples outside the TG community. I am not just talking about TLGB here. Some Intersexed people could find themselves in a position where they cannot marry anyone, you could even have a member of a straight couple whose chromosomes don't match what Texas thinks they should be an be declared not the gender they think they are. As a result many benefits could be lost if one of the spouses dies.

Now many of you are thinking this is just another good reason to abolish the rule that says a married couple must consist of a man and a woman, and you would be correct. But in this case there is something that a portion of the transgendered community can do to reward the state of Texas for their colossal Ignorance. If you are a MtF and have a sexual partner preference of Female (a lesbian couple after transition) or If you are a FtM and have a sexual partner preference of Male (a gay couple after transition), you can now be legally married in the state of Texas. If enough of us take advantage of this (and we make sure the press gets all they need for publicity) Texas could become known as the Lesbian & Gay Marriage Capitol of the world. While this would not erase the damage caused by the ignorance of the Texas court, it would give them a reason to wake up and become part of the 21st Century.
